An unidentified motorcycle rider died from injuries suffered in a crash on Sunday afternoon in Elk Grove.
The Elk Grove PD reported that the one person collision occurred on northbound Elk Grove Florin Road just south of Sheldon Road.
The rider was immediately transported to the hospital with life-threatening injuries but was unable to recover. It is believed that alcohol and speed were factors.
Our thoughts and prayers go out to the family and friends of the victim of this tragedy.
Motorcycle accident wrongful death claims
The unexpected loss of a loved one from such a tragedy is something no one can prepare for. On top of the pain their absence will cause, there can be unfortunate financial consequences for those who relied on the person who passed.
California law allows family members to bring an action on behalf of the victim to seek financial compensation for the loss of their loved one. This is called a wrongful death claim.
The family members will be able to seek damages for things like medical bills, funeral costs, lost income, loss of household services and others. In order to have a successful claim, the family members must be able to prove that the person died due to the negligence or wrongful acts of another.
It is possible for a wrongful death claim even where there was a no contact motorcycle crash.
What is a no contact bike crash?
A “no contact” bike crash can happen when another vehicle causes a motorcycle to wreck without there being a collision between them. This type of accident can happen in several ways and can cause serious injury or death.
No contact wrecks can occur just about anywhere on the road. But many times they happen at intersections or due to unsafe lane changes. Although riders may successfully avoid the collision with the other vehicle, serious injury or death can occur because of the vulnerabilities while riding a motorcycle.
Can another driver be held liable for a no contact accident?
If the other driver acted negligently, they can be found liable. Every person on the road has a duty to other drivers. This is to obey traffic laws and to act reasonably given the circumstances and conditions of the road.
If a driver breaks the law or acts in an unreasonable way, this is called a breach of that duty.
It also must be shown that the death was caused by the driver’s breach of the traffic laws or their actions.
Finally, there must be damages. If a person is killed in a motorcycle accident, this element is fulfilled.
